Research
Within the areas of administrative law and the foundations of law I am particularly interested in the figure and functions of individual rights (as opposed to law in the objective sense). What does it mean to have a legal right? Are all legal rights reducible to claim-rights? Moreover, my research focuses on the way in which substantive law and procedural law interact in modern legal systems. My interest in the law of (administrative) court procedure falls in this line of research, along with its differences from civil procedure and the peculiarities and limitations of the judicial form.
Regarding the law of digitalization, my interest lies first in the special conditions and legal regulation of communication in the digital space. How, for example, does one get to grips with the special dynamics according to which statements spread in digital channels? Do we need new instruments of legal protection against disinformation? And how are such mechanisms compatible with freedom of expression and the basic assumptions of our constitution that underpin it? I will be continuing my previous work on these topics as a postdoctoral research project in the coming years.
In addition, I would like to critically follow developments in the area of data protection law, which is making advances in an extremely dynamic way. What exactly is the interest in protecting “our” data? And how can we legally balance it with the need for information? For example, what connections and frictions exist between the protection of online anonymity and the enforcement of rights and duties in the digital space?
